ELECTROLETE TERMS OF SERVICE

PLEASE READ THESE TERMS OF SERVICE (“AGREEMENT”) CAREFULLY.
This Agreement is a legal agreement between you (“you,” “your,” or “Customer”) and ELECTROLETE (“we,” “us,” or “ELECTROLETE”), the owner and operator of the website (the “Site”). This Agreement governs your use of the Site, the products sold on it, and any memberships or subscriptions offered.

By accessing or using the Site, you agree to be bound by this Agreement. If you do not agree, you may not access or use the Site or purchase any products.

1. ELIGIBILITY

If you are a parent or guardian purchasing on behalf of a minor, you agree to this Agreement on their behalf and accept responsibility for their use.

ELECTROLETE reserves the right to modify, update, or remove any part of the Site or this Agreement at any time without prior notice.

By using the Site, you agree to our Privacy Policy, which explains how we collect, use, and protect your personal information.

3. ACCOUNT SECURITY & USE OF SITE

3.1 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account

Notify us immediately of any unauthorized use.

3.2 Acceptable Use

You agree not to:

  • Attempt to hack, scrape, or disrupt the Site
  • Use bots, spiders, or automated systems
  • Engage in illegal activity
  • Copy, reproduce, or exploit content without permission

Violation may result in termination of access.

4. TERMS OF SALE

4.1 Personal Use Only

Products are sold for personal, non-commercial use only. Resale or redistribution is prohibited.

4.2 Pricing

4.3 Refund Policy

5. SUBSCRIPTIONS

When you purchase a subscription:

  • You will receive recurring deliveries based on your selected frequency
  • Your payment method will be charged automatically until canceled

You may cancel or modify your subscription at any time through your account dashboard.

6. PRE-ORDERS

Pre-orders are purchases of items not yet in stock. Payment is processed at checkout.

  • You may cancel before fulfillment
  • Once shipped, standard return policies apply

7. PAYMENTS

We accept major credit/debit cards.

By purchasing, you agree:

  • To pay all applicable fees, taxes, and shipping
  • That payments are processed securely via third-party providers

Failure to process payment may result in order cancellation.

8. SHIPPING

Shipping times are estimates and not guaranteed.

  • Risk of loss transfers upon delivery to the carrier
  • ELECTROLETE is not responsible for delays caused by carriers

9. GIFT CARDS (IF APPLICABLE)

  • Gift cards are non-refundable and not redeemable for cash (except where required by law)
  • They do not expire
  • Lost or stolen cards may not be replaced without proof

10. REFERRALS (IF APPLICABLE)

Participation in referral programs must comply with:

  • Applicable laws
  • Anti-spam policies
  • Honest and non-deceptive practices

We reserve the right to revoke credits or terminate participation at any time.

11. INTELLECTUAL PROPERTY

All content on the Site—including branding, logos, text, and images—is owned by ELECTROLETE and protected by law.

You may not use or reproduce any materials without written permission.

12. THIRD-PARTY LINKS

The Site may contain links to third-party websites.

We do not control or endorse these sites and are not responsible for their content or practices.

13. DISCLAIMER OF WARRANTIES

The Site and all products are provided “AS IS” without warranties of any kind.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Specific results from product use

Use is at your own risk.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

ELECTROLETE shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or use

Maximum liability shall not exceed:

  • The amount you paid for the product, or
  • $100 USD (whichever is greater)

15. DISPUTES & ARBITRATION

Any disputes shall be resolved through:

  • Binding arbitration (not court), or
  • Small claims court where applicable

You agree:

  • Not to participate in class actions
  • That disputes will be handled individually

16. GOVERNING LAW

This Agreement is governed by the laws of the State of Florida, unless otherwise required by applicable law.

17. ELECTRONIC COMMUNICATIONS

By using the Site, you consent to receive communications electronically (email, site notices, etc.).

18. GENERAL TERMS

  • We may suspend or terminate access at our discretion
  • If any provision is invalid, the rest remains enforceable
  • This Agreement represents the entire agreement between you and ELECTROLETE

ELECTROLETE Mobile Terms of Service

The ELECTROLETE mobile message service (the "Service") is operated by ELECTROLETE (“ELECTROLETE”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to ELECTROLETE’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ELECTROLETE through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with ELECTROLETE. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18449565123 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other ELECTROLETE mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
